According to the petitioner, he has been attending the works of repairing the electrical motor, hand pumps etc. assigned by the third respondent Panchayat for the past 7 years. He was a successful bidder in the tender floated by the third respondent herein. Pursuant to the same, he has attended to 29 works at various places between July and November 2018 and the total amount due for those works is Rs.2,65,892/-, besides Rs.85,609/- towards supply of spares to the third respondent, but no payment was made to him and the officials of the second and third respondents have been dragging the petitioner all along and asking him to visit their office on several times, without effecting any payment, till date. Hence, the petitioner sent a legal notice dated 26.08.2020 to the respondents requesting to pay Rs.3,51,501/- [Rs.2,65,892/- + Rs.85,609/-] to him. Finding no response on the same, he has come up with this writ petition seeking a direction to the respondents in this regard. 2/5
2.Today, when the matter was taken up for consideration, the learned counsel for the petitioner submitted that the petitioner may be permitted to submit a fresh representation enclosing the relevant documents to the respondents for the relief claimed herein, for which, there is no serious objection on the side of the respondents.
3.In view of the above, the petitioner is permitted to make a fresh representation enclosing all the required documents along with a copy of this order to the respondents, within a period of two weeks from the date of receipt of a copy of this order. On such representation being made, the respondents shall consider the same and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks thereafter. 4.Accordingly, this Writ Petition is disposed of.
