ORDER

The petitioner has challenged the look-out circular issued by the respondents-Police.

Learned Senior Counsel appearing for the petitioner submitted that this Court had already granted order of stay on 16.08.2023 in respect of the investigation in Crl.M.P.No.12271 of 2023 in Crl.O.P.No.18440 of 2023 relating to Crime No.409 of 2023. Despite the grant of stay by this Court, the respondentsPolice proceeded with the investigation and also laid the charge-sheet before the jurisdictional Court. Further, the matter between the parties is purely a family dispute and the petitioner is working in foreign country and the de-facto complainant is living with two children. The matrimonial dispute is pending between the parties and unfortunately, the respondents-Police without even adhering to the order of stay granted by this Court, the Police have also laid the charge-sheet and now being issued the look-out circular, illegally, and therefore, the same is liable to be set aside.

On a perusal of the records, it shows that the petitioner has already filed Crl.O.P.No.18440 of 2023 filed to call for the records in connection with FIR in Crime No.409 of 2023 pending on the file of the respondent-Police and to quash the same and along with the said Crl.O.P., the petitioners have also filed Crl.M.P.No.12271 of 2023 for stay of the investigation till the disposal of the said Crl.O.P., which is still pending. However, this Court, by order dated 16.08.2023, granted interim stay of the investigation in Crime No.409 of 2023 pending disposal of the said Crl.O.P.

4. Admittedly, the said Crl.O.P. is still pending. Despite the order of stay granted by this Court, the respondents-Police have investigated the matter and also filed charge-sheet. Not stopping with that, there was interference in the matrimonial dispute pending between the spouses and they have also given look-out circular, which is unwarranted, and therefore, the look-out circular issued by the respondents-Police is hereby quashed.

5. Since pending the said Crl.O.P., this Court passed the order of stay for investigation and that they have also completed the investigation, and therefore, it is clear violation of the order of this Court granting stay. 3 / 6

6. Admittedly, the said Crl.O.P. is still pending. The order of stay is in force till the disposal of the said Crl.O.P., and pending the present Crl.O.P., the investigating agency conducted investigation and also laid charge-sheet, which is nothing but violation/disobedience of the order of stay granted by this Court. The present Writ Petition is allowed accordingly. Consequently, the miscellaneous petition is closed.

7. Further, this Court suo-motu issues contempt notice against the respondents 1 to 3 herein/Police. Registry is directed to issue statutory notice to the respondents 1 to 3/Police, returnable in four weeks. List the suo-motu contempt petition for hearing, after numbering it. 12.06.2025 cs To
