This petition is filed by the petitioner / appellant / claimant seeking to condone the delay of 269 days in filing the above Appeal.

2. Heard both sides. The learned standing counsel for R-3 / Insurance Company stated No Objection in ordering this petition. Despite serving notice on the second respondent and his name printed in the cause-list, there is no representation on behalf of him.

3. Therefore, having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay is condoned, subject to the condition that the petitioner / appellant / claimant is not entitled to any interest for the default period, in the event of succeeding in the Appeal.

4. This petition is ordered accordingly.
