Challenging the order of rejection dated 16th May, 2015, the present writ petition is filed and a further direction is also sought for to direct the respondent to issue Hall Ticket for the written examination for recruitment to the post of Sub-Inspector of Police scheduled to be held on 23rd May, 2015.
2. The writ petitioner states that she has completed +2 course and applied for recruitment to the post of Sub-Inspector of Police in the Tamil Nadu Uniformed Services. However, the application submitted by the writ petitioner was rejected on the ground that the writ petitioner is over aged. Challenging the order of rejection, the present writ petition is moved. The contention set out in this writ petition is that the writ petitioner after getting married continued her studies, but the
date of birth recorded in her school record was erroneous and in this regard, she made an attempt to correct the same. Further, in paragraph-6 of the affidavit filed in support of this writ petition, it is stated that the writ petitioner had approach the High Court for making the correction in her date of birth as 24 February, 1986, instead of 03 June, 1985. According to the petitioner, her date of birth was mistakenly entered in her school record as 03 June, 1985, instead of 24 February, 1986. Thus, the relief is sought for even for correction of date of birth.
3. Alteration of date of birth in school records cannot be done in the manner adopted by the writ petitioner in this writ petition. The date of birth is to be registered in a manner known to law, more specifically under the provisions of the Registration of Births and Deaths Act, 1969. The writ petitioner, even in case of correction, has to approach the competent authorities under the provisions of the said Act and make necessary corrections in the school records. However, without correcting the date of birth in her school records, the application filed before the respondent for recruitment to the post of Sub-Inspector of Police cannot be entertained and therefore, the order of rejection issued by the respondent in this regard is in order and there is no infirmity. It is left open to the writ petitioner to approach the competent authorities for correction of her date of birth and even before correction, the application for recruitment is made in the present writ petition and the same cannot be considered on merits by this Court in this writ petition.
4. In this view of the matter, no relief as such sought for in this writ petition can be granted and accordingly, the writ petition stands dismissed. However, there is no order as to costs. Consequently, the connected miscellaneous petition is also dismissed.
