ORDER
Challenging the order passed by the 3rd respondent, dated 17.10.2022, the petitioner has filed the present writ petition.
2. Heard both sides and perused the materials available on record.
3. As against the impugned order passed by the 3rd respondent, there is an effective appeal remedy available before the 1st respondent/ District Collector u/s 36(e) of the Tamil Nadu Minor Mineral Concession Rules, 1959. Without doing so, filing the present writ petition is per se unsustainable. Hence, this Writ Petition is liable to be dismissed.
4. Accordingly, this Writ Petition is dismissed, granting liberty to the petitioner to file an appeal before the 1st respondent u/s 36(e) of the Page No.2 of 4
Tamil Nadu Minor Mineral Concession Rules, 1959. The period pending before this Court is excluded for the purpose of limitation. No costs.
