ORDER

This criminal original petition has been filed to direct the Special court for SC/ST Act at Thiruvannamalai District (Principal district and Sessions Court, Thiruvannamalai) to consider the Petitioners bail application on the same day on his surrender in Cr.No.37 of 2026 pending on the file of the Deputy Superintendent of Police, Cheyyar Range, Cheyyar, Thiruvannamalai District. 2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

3.It is seen from the records that the petitioner is not a named accused in Crime No.37 of 2026. The petitioner is the brother of one Padmanabhan. The defacto complainant Jagadeesan married the sister of Padmanabhan, who is A1 in this case. The said Padmanabhan along with about 15 members of his relatives, went to question the defacto complainant and verify the well-being of his sister. It is now projected that the petitioner also accompanied the said Padmanabhan. The petitioner is aged about 74 years old.

4.In view of the above factual position, there shall be a direction to the Special Court for SC/ST Act at Thiruvannamalai District (Principal District and Sessions Court, Thiruvannamalai) to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.37 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
