O R D E R

This writ petition has been filed for the issue of writ of mandamus directing the 1st respondent to act upon the application submitted by the petitioner wherein the petitioner is seeking for issuance of patta in her name with respect to the subject property.

2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 & 2. 3.The specific case of the petitioner is that her husband is the owner of the subject property by virtue of registered sale deed dated 26.08.1983. Patta was also issued in the name of the petitioner's husband. The petitioner's husband died on 05.06.2001 leaving behind the 2/5

petitioner and his children. The petitioner submitted a representation dated 26.07.2024 seeking for patta. Based on the same, the 1st respondent called the petitioner for an enquiry and the petitioner also attended the enquiry and submitted all the relevant documents. 4.The petitioner thereafter received a communication dated 02.12.2024 from the 1st respondent stating that the relevant re-survey documents are not available with them and asked the petitioner to produce the necessary documents. On receipt of the same, a legal notice was also sent to the 1st respondent stating that the name of the 3rd respondent has been entered in the revenue records by mistake and hence, the same has to be rectified. Even after the receipt of the same, there was no proper response from the side of the 1st respondent. It is under these circumstances, the present writ petition came to be filed before this Court.

5.Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 1st respondent to deal with the representation made by the petitioner based on the documents which are already been furnished by 3/5

the petitioner and pass necessary orders with respect to grant of patta in the name of the petitioner and her children within a period of four (4) weeks from the date of receipt of a copy of this order. 6.In the result, this Writ Petition is disposed of with the above directions. No costs.
