ORDER
The petitioner, who was arrested and remanded to judicial custody on 11.01.2026 for the alleged offences under Sections 126(b), 296(b), 311 and 351(3) of B.N.S. in Crime No.40 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused demanded money from the defacto complainant to consume liquor and when the same was refused, the accused threatened the defacto complainant, snatched a sum of Rs.2,100/- from his pocket at knife point. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that co-accused were already granted bail and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed to grant bail to the petitioner.
4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail on the ground that there are 11 other previous cases pending against the petitioner.
5. From the submissions made by the learned Government Advocate, it appears that the petitioner has been incarcerated since 11.01.2026. Though the petitioner has been under judicial custody for the past past more than 50 days and the co-accused were released on bail, considering the severity of allegations against this petitioner and considering the past antecedents of the petitioner, this Court is not inclined to enlarge the petitioner on bail.
6. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
