ORDER
The petitioner, who was arrested and remanded to judicial custody on 18.02.2026 for the alleged offences under Sections 4(1)(c) and 4(1-A)(ii) of
Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.35 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was in illegal possession of 32 brandy bottles containing 180ml each.
3. The learned Government Advocate (Criminal side) strongly objected by stating that there are 78 previous cases and out of which, 30 cases are still pending. Whereas the learned counsel appearing for the petitioner would submit that all the said cases have been disposed of.
4. While looking at the submissions made by either side, it appears that there are 78 previous cases, which clearly indicates that every time, the petitioner is misusing the liberty granted by this Court. Therefore, this Court is of the opinion that it is not desirable to enlarge the petitioner on bail at this time.
5. Accordingly, this Criminal Original Petition is dismissed. 05-03-2026 MJS
