ORDER

The petitioner, who was arrested and remanded to judicial custody on 17.02.2026 for the alleged offences under Sections 296(b), 115(2), 118(1), 109 and 351(3) of B.N.S. in Crime No.15 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 17.02.2026, the petitioner abused the defacto complainant in filthy language, assaulted him using knife and criminally intimidated him with dire consequences Hence, this case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. Therefore, he prays to enlarge the petitioner on bail.

4. Whereas the learned Government Advocate (Criminal side) appearing for the respondent police strongly opposed to enlarge the petitioner on bail on the ground that the petitioner stabbed the victim, due to which, he sustained grievous injury and therefore, if the petitioner is enlarged on bail, there is every possibility for tampering of witnesses. He further submitted the photographs of the injured.

5. While looking at the photographs of the injured, the severity of the injury sustained by the victim is visible. In such view of the grievous injury sustained by the victim, considering the gravity of the allegations against this petitioner and considering the objection made by the learned Government Advocate, this Court is of the opinion that it is not desirable to enlarge the petitioner on bail at this point of time.

6. Accordingly, this Criminal Original Petition is dismissed. 05-03-2026 MJS Note:
