Writ Petition filed under Article 226 of the Constitution of India parying to issue a Writ of Mandamu, directing the respondents to initiate the process of re-valuation of teh petitioner's answer sheet of Law Paper I, with respect to the examination held on 05.08.2023 vide Notification No.34/2023, dated 01.03.2023 as far as the petitioner's Registration No.3420235301 is concerned based on the tabulation mentioned in para 15 of the present affidavit and consequently submit the re-valuation report before this Court. O R D E R
(Order of the Court was made by R.SUBRAMANIAN, J.) The petitioner seeks a Mandamus for re-valuation of the descriptive answers in the Main Examination for selection of Civil Judge - Direct Recruitment for Puducherry Union Territory.
2. The notification issued by the High Court calling for applications makes it clear that no re-valuation or re-totalling of the marks in the Preliminary as well as the Main Examination will be entertained. Moreover, the valuation of the Main Examination was done by the District Judges and it is the discretion of the valuer to award marks. This Court sitting under Article 226 jurisdiction will not interfere with the discretion of the valuer/ examiner. A similar view has been expressed by the Division Bench of this Court in the order made in W.P.No.12671 of 2024 dated 20.06.2024. Page No.: 2 of 5
3. Hence, we see no merit in this Writ Petition. The Writ petition therefore fails and it is accordingly dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
