2/6 PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for records of the file of the 3rd respondent pertaining to the refusal check slip No RFL/Pallipalayam/118/2024 dated 11.11.2024 and quash the same and consequently direct the 3rd respondent to register the Sale Deed presented by the petitioner in respect of her properties vide the Temporary no. in TP/199321995/2024 dated 11.11.2024.

ORDER

The Revenue Divisional Officer, Thiruchengode is suo motu added as the th respondent in this writ petition.

2.This writ petition has been filed challenging the impugned refusal Check Slip dated 11.11.2024 issued by the 3 rd respondent and for a consequential direction to the 3 rd respondent to entertain and register the Sale Deed dated 11.11.2024 executed by the petitioner.

3/6 3.Heard Mr.T.Saikrishnan, learned counsel appearing on behalf of the petitioner and Mr.U.Baranidharan, learned Special Government Pleader appearing on behalf of respondents 1 to 3.

4.The refusal Check Slip has been issued on two grounds. The first ground is that a protest petition was given by the 4 th and 5 th respondents not to entertain any further documents with respect to the subject property. The 2 nd ground is that the 4 th and 5 th respondents have already given a petition to the Revenue Divisional Officer seeking for the cancellation of the patta and the said proceedings are pending.

5.This Court heard the learned counsel appearing on either side. It is brought to the notice of this Court that pursuant to the petition submitted by the th and 5 th respondents, the Revenue Divisional Officer, Thiruchengode has already issued summons to the parties and the petitioner appeared for the enquiry on 27.02.2025 and had submitted all the relevant documents. Hence, it will be more appropriate to direct the Revenue Divisional Officer, Thiruchengode to enquire and pass orders within a time frame. Once orders are

4/6 passed, there will be more clarity with respect to the right of the petitioner and it will be more easier for the 3 rd respondent to deal with the document that is presented for registration.

6.In the light of the above discussion, there shall be a direction to the impleaded 6 th respondent to complete the enquiry after affording an opportunity to both the parties and pass final orders, within a period of six weeks from the date of receipt of copy of this order. Depending upon the orders passed by the Revenue Divisional Officer, it is left open to the petitioner to proceed further to register the document.
