A.No.3572 of 2022 A.No.3572 of 2022 in C.S.(DR).No.35884 of 2022 KRISHNAN RAMASAMY, J., This application has been filed seeking to grant leave to file a partition suit in respect of the C, D and E outside jurisdiction schedule properties.

2. The learned counsel appearing for the plaintiff submitted that both the plaintiff as well as the respondents are residing within the jurisdiction of this Court. There are five schedules in the property. Out of the five schedules, schedule Nos.A and B are situated within the jurisdiction of this Court and schedule Nos.C, D and E are situated outside the jurisdiction of this Court. Therefore, the present application has been filed.

3. Considering the submission made by the plaintiff and both the plaintiff as well as the respondents are residing within the jurisdiction of this Court and Schedule Nos.A and B properties are situated within the jurisdiction of this Court, this Court is of the considered view that it is appropriate to grant leave to file the partition suit in respect of the https://www.mhc.tn.gov.in/judis 1/2

A.No.3572 of 2022 KRISHNAN RAMASAMY, J., gbi schedule Nos.C, D and E which are situated outside the jurisdiction of this Court. Hence, this Court is inclined to grant leave to file the partition suit in respect of the C, D and E outside jurisdiction schedule properties.
