Prayer:Writ Petition is filed under Article 226 of Constitution of India, for issuance of writ of Certiorari, calling for the records of the 2nd respondent pertaining to his communication dated 29.02.2024 in Reference No.SCN/317213869/24 and quash the same.

O R D E R

The order passed by the Regional Passport Officer, Coimbatore dated 29.02.2024, asking the petitioner to surrender the Original Passport is under challenge in the present writ petition.

It is not in dispute that criminal case has been registered against the petitioner under the provisions of the Dowry Prohibition Act and Indian Penal Code on the file of All Women Police Station, Thiruverambur, in Crime No.20/2023 dated 01.11.2023.

Mr.K.Srinivasamurthy, learned Senior Panel Counsel appearing on behalf of the respondents would submit that arrest warrant has been issued against the writ petitioner. Therefore, the Passport Officer asking the petitioner to surrender the Passbook.

Since arrest warrant has been issued, the petitioner is bound to surrender the Passbook. If at all the petitioner wants to secure any relief, he is at liberty to approach the jurisdictional Criminal Court of law for appropriate remedy.

However, it is made clear that the petitioner is bound to surrender the Original Passbook immediately to the Regional Passport Office, Coimbatore.

Accordingly, this Writ Petition stands dismissed at the admission stage itself. No costs. Consequently, connected miscellaneous petition is closed.
