O R D E R
This Contempt Petition has been filed against the noncompliance of the order and direction issued by this Court in W.M.P.No.17836 of 2016 in W.P.No.8137 of 2016, dated 22.06.2016.
2.The controversy has now come to a finality, as the District Collector, Coimbatore has quantified the amount of compensation payable in respect of damages caused to the petitioner's immovable property, based on the land holding of each of the petitioners, by proceedings No. e/f/27472/2012/C1 dated 28.07.2016.
3.Though from the copy of the proceedings which has been produced before this Court that it has been forwarded to the Superintending Engineer/Civil/Project/TANGEDCO, EVN Road, Erode-9, the learned Senior Counsel appearing for the TANGEDCO submits that till date their Officers have not received the copy of the said communication.
4.The learned Additional Advocate General appearing for the District Collector submits that if the proceedings has already not been communicated, the same will be done by 'Registered Post with Acknowledgment due', within a period of one week from the date of receipt of a copy of this order.
5.Once the Authorities for TANGEDCO receive the copy of the order then what remains to be done is to effect payment as per the quantification done by the District Collector. This Court is of the view that four weeks time would be a reasonable period, within which the TANGEDCO can
pay the amount as quantified by the District Collector in his proceedings dated 28.07.2016, through Banking Channel. This Court is of the fond hope that the matter will not be once again mentioned before this Court and this order should put rest of the dispute between the parties. The Contempt Petition is closed accordingly.
