Without prejudice to the rights and contentions of the respondent /plaintiff with regard to the averments contained in the affidavit filed in support of A. No.1517 of 2024, the said application is allowed. The said application has been filed seeking to condone the delay in filing an application seeking to set aside the exparte order, dated 29.11.2023 passed in A. No.5720 of 2023.

2. Registry is directed to number the application filed by the defendant seeking to set aside the exparte order, dated 29.11.2023, if the same is otherwise in order. It is made clear that the respondent / plaintiff can raise all objections available to the respondent / plaintiff in the said application despite the fact that the condone delay application has been allowed. Post the matter on 03.04.2024.
