CRIME NO.234 OF 2018 2 R.NIRAISELVI Petition praying that in the circumstances stated therein the High Court will be pleased to stay of all further proceedings against the Petitioner in Crime No.234/2018 on the file of Inspector of Police, CCB-I, Egmore, Chennai herein pending disposal of the above said Crl.OP.8323/2019.

Order : This petition coming on for orders upon perusing the petition and NO APPEARANCE for the petitioner and of THE PUBLIC PROSECUTOR(R-1) and of M/S P.KUMARESAN Advocate(R-2)on behalf of the Respondents the court made the following order:- Today when the matter is called up, nobody represented on the side of the petitioner. Learned counsel for the 2nd respondent submitted that based on the earlier order of this Court dated 28.03.2019, the first respondent police completed the investigation in F.I.R. No.234 of 2018 and charge sheet has also been filed against the petitioner. Since the petitioner is not ready for further enquiry, the respondent police are not in a position to proceed further.

2. In view of the above circumstances, this Court is not inclined to extend the stay already granted by this Court on 28.03.2019 and the same is vacated. Crl.M.P. No.4454 of 2019 is hereby dismissed. The first respondent Police is directed to proceed further as per the manner known to law.
