O R D E R
The petitioners, who are the accused A1 to A4, in Crime No.526 of 2022 for the offences under Section 406, 420, 506(1) of I.P.C., had filed this quash application primarily on the ground that according to the de-facto complainant, the project was conceptualised in the year 2016 and thereafter, for noncompletion of the project, a complaint was lodged in the year 2021 and FIR came to be registered in the year 2022.
2.According to the petitioner, the alleged offence had taken place in the year 2016. But, it is almost 10 years, the case is still in the initial stage and no proper investigation has been conducted. He further submitted that the case is purely Civil in nature and it has been given a criminal colour. The 1st petitioner is a Union leader of the Tamil Nadu State Transport Corporation. As a leader of
the Union, he had proposed to construct 50 houses to the members, for which he had approached A2 and A3. The Cooperative Society had agreed to give a loan. The de-facto complainant has taken steps to process the loan and he was unable to submit proper documents. Hence, made false allegations against the petitioners.
3.Mr.Leonard Arul Joseph Selvam, learned Additional Public Prosecutor, who takes notice for the 1st respondent, submits that A1 claims to be the Union Leader of Tamil Nadu State Transport Corporation, A2 and A3 are the members of the Cooperative Society. They have made a false promise as though they are ready with the land and also in the said land, 50 houses can be constructed for the Union members and the society is ready to pay the loan amount. On believing the petitioner's claim, the de-facto complainant has paid Rs.27,57,000/- through bank transfer. The entrustment of Rs.27,57,000/- has been proved. Thereafter, the discharge has to be proved by the petitioners, which they failed to do so. It is the case of misappropriation and cheating. He says that there is some delay in lodging the complaint and initially there was some slackness in the investigation. Now, the Deputy Commissioner, Tambaram is monitoring the investigation. Soon, the final report will be filed in this case, preferably within a period of six months.

GSA 4.In view of the same, this Court is not inclined to pass any further order. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
