Srichand Chhabria v. Crown Rotmax Engineering Pvt. Ltd.

O.A.No.194 of 2020 has been filed to grant an order of adinterim injunction restraining the respondents/defendants or their men, agents, servants or subordinates acting on their behalf from in any way alienating, encumbering or dealing with the suit property more fully described in the suit scheduled hereunder pending disposal of the suit.

2. Vide, order, dated 14/9/2020, this Court had granted an order of status-quo in so far as the subject matter of O.A.No.194 of 2020, until further orders.

3. Since status-quo is ordered, until further orders, instant Original Application is closed

. A.No.1281 of 2020 has been filed to direct the respondent/defendant to furnish a security to the tune of Rs.1,03,00,000/-.

Since fifth defendant refused to receive notice, she was set ex parte, vide, order, dated 14/9/2020.

. Today, when the matter is taken up for hearing, learned counsel appearing for the plaintiff would submit that notice has not been received by the first defendant/Director of Crown Rotmax Engineering Pvt Ltd., Chennai. His conduct shows that he is purposefully evading the service. Hence, he is set ex parte.

Vide, order, dated 14/9/2020, this Court had granted an order of status-quo in so far as the subject matter of O.A.No.194 of 2020, until further orders.

In A.No.1281 of 2020 - no other security is required to be given.

Post the matter for filing written statement. 6811 of 2019 is closed. Post on 11/12/2020. Status-quo passed by this Court in respect of 194 of 2020 shall continue until the disposal of the suit. Accordingly, application is closed.
