This petition has been filed seeking to condone the delay of five days in filing the Criminal Revision against the order passed in Crl.M.P.No.4118 of 2018 in C.C.No.30 of 2013 on the file of the learned IX Additional Special Judge for CBI Cases, Chennai, dated 06.12.2018.

2. The learned counsel appearing for the petitioner would submit that due is continuous travelling abroad for his business work, the petitioner was unable to file the Criminal Revision within a period of limitation and that there had been delay of five days in fling the Criminal Revision. He would further submit that the delay is neither wilful nor wanton on the part of the petitioner.

3. The learned Special Public Prosecutor for CBI takes notice on behalf of the 2nd respondent.

kv 4.Taking into consideration the affidavit filed by the petitioner and also the submissions made by the learned counsel on either side, I am inclined to allow this petition.

5. Accordingly, this petition is allowed and the delay of five days in filing the Criminal Revision is condoned.
