Seeking leave to sue the third respondent, the applicant/plaintiff has come up with this application.

2.Applicant is the plaintiff in the suit filed for partition and separate possession. Learned counsel appearing for the applicant submits that the schedule mentioned properties are situated within the territorial jurisdiction of this Court and one of the respondents viz., the third respondent is residing outside the territorial jurisdiction of this Court.

3.Considering the submission made by the learned counsel for the applicant and also considering the averments made in the plaint, leave is granted.
