C.M.P.No.11052 of 2019 CMP No.11052 of 2018 in Tr. CMP No.1078 of 2017 V.BHAVANI SUBBAROYAN.,J The petitioner herein has filed the Transfer Civil Miscellaneous petition seeking for transferring the P.O.P. No. 2 of 2016, pending on the file of Principal District Judge, Vellore to the Principal District Judge, Salem.

Since, the above said transfer Civil Miscellaneous petition was taken up for hearing on 19.04.2018 by this Court, but there was no representation on behalf of the petitioner and hence, posted the matter for hearing on 20.04.2018. On 20.04.2018 also there is no representation on behalf of the petitioner and therefore, this Court dismissed the petition for default.

The petitioner has now filed a petition in CMP No.11052 of 2018 to condone the delay of 17 days in filing the restoration petition. 4.

The learned Special Government Pleader took notice for R7 http://www.judis.nic.in 1/2

C.M.P.No.11052 of 2019 to R9. R1- Tahsildhar took notice on 17.07.2018 and for R2 notice was not served as "addressee moved" from that place. 5.

When the matter is taken up for hearing today, the Party-inperson represented that during February 2018, the main P.O.P. No.2 of 2016 filed by him before the Principal District Judge, Vellore was dismissed and he has not filed any appeal against the same till date. 6.

In view of the above submission, the prayer sought for by the petitioner in the main transfer civil Miscellaneous petition has become infructuous. Accordingly, this Civil Miscellaneous petition filed by the petitioner is also dismissed.
