O R D E R
This writ petition has been filed to direct the 2nd and 3rd respondents to hand out the petitioner balance entitled sum of Rs.24,60,000/- as per the 2nd respondent proceeding Na.Ka.No.1343/2019/AA4 dated 29.11.20219 within a time bound period by considering the representation dated 14.12.2023.
2. The petitioner is a registered Government Contractor. Under the Integrated Urban Development Mission Scheme for the year 2019-2020. The petitioner participated in the tender and he was successful bidder and received the work order from the 3rd respondent vide Roc.No.227/2017 dated 31.12.2019. The 2nd respondent sanctioned an estimated sum of Rs.1,06,00,000/- as Government Subsidy and a sum of Rs.26,60,000/- as Urban Local Bodies Share and total estimated value for a sum of Rs.1,33,00,000/- for the construction of the road work at Seerapalli, Namakkal District. The petitioner completed the work within the time limit fixed by the 3rd respondent, by taking financial aid from his friends and 2/5
relatives. Whereas, the respondents 2 and 3, failed to settled the amount due for a sum of Rs.24,60,000/- from the public fund out of Rs.26,60,000/- and paid only a sum of Rs.2,00,000/-. The petitioner made representation to the respondents on various dates to settle the due amount. Hence, the present writ petition.
3. The learned standing counsel for the third respondent would submit that the balance amount would be paid to the petitioner within the period of six months time, as there is financial crisis in the third respondent/Panchayat.
4. Heard the learned counsel for the petitioner and the learned counsel for the respondents and perused the materials available on record.
5. The third respondent is directed to settle the admitted amount of Rs.24,60,000/- to the petitioner in six equal monthly instalments along with interest at 6% p.a.. with the following directions :- (i)Each instalment has to be paid on or before 10th of every month. (ii)The first instalment shall commence from the month of May 2025. (iii)The last instalment shall be paid on or before 10th October 2025. 3/5
(iv)If the 3rd respondent defaults in paying any one of the monthly instalments, the petitioner is at liberty to approach this Court. 6.This writ petition is disposed of, with the above observations and directions. No costs.
