Seeking leave to sue the respondents, the applicant/plaintiff has come up with this application.

2.Applicant is the plaintiff in the suit filed for perpetual injunction and other reliefs. Learned counsel appearing for the applicant submits that the Memorandum of Understanding dated 29.04.2003 has been entered into between the applicant and the fourth respondent within the territorial jurisdiction of this Court, by which the EPS business of the applicant was transferred in favour of the fourth respondent. He further submits that contrary to the said Memorandum of Understanding, two separate companies have been started in the very same name.

3.Considering the submissions made by the learned counsel for the applicant and also considering the averments made in the plaint, leave is granted.
