ORDER
The petitioner, who was arrested and remanded to judicial custody on 24.12.2025 for the alleged offences under Sections 329(4), 296(b), 308(2), 309(4), 311 and 351(3) of B.N.S. in Crime No.437 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner came to the TASMAC bar, where the defacto complainant is working, picked up quarrel with him, abused him in filthy language, damaged the bar materials and robbed a sum of Rs.1,200/- from the cash box and attempted to attack him using knife and also threatened him with dire consequences. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the respondent police have foisted a false case against the petitioner only for a statistical purpose and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed to grant bail to the petitioner.
4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail on the ground that there are 16 other previous cases pending against the petitioner.
5. From the submissions made by the learned Government Advocate, it appears that the petitioner is under incarceration since 24.12.2025 and the petitioner has 16 previous cases in his credit, which clearly demonstrate that as and when the petitioner was enlarged on bail, he is misusing the liberty and subverting the same and therefore, this Court is not inclined to enlarge the
petitioner on bail on the ground that if the petitioner is enlarged on bail, once again he may indulge in similar kind of activities.
6. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
