Vithya v. State Rep.By
Crl.O.P.No.6746 of 2024 Crl.O.P.No.6746 of 2024 C.V.KARTHIKEYAN, J.
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 254(B), 355 of IPC and Section 4 of Tamil Nadu Women Harassment Act @ 294(b), 323, 354(b), 355 of IPC and Sections 11 & 12 of the POSCO Act, 2012 in Crime No. 419 of 2024, seek anticipatory bail.
2. It is stated that there are two victim children. They are both daughters of the first petitioner. The husband of the first petitioner had died. The first petitioner is now living with the second petitioner. When the two victim child visited their mother, the second petitioner had committed the offence under Sections 11 and 12 of the POSCO Act.
3. The learned counsel for the petitioner stated that the victim children want a share of the award granted for MCOP cases. That contention is rejected. There is no legal right for the second petitioner or even for the first petitioner to exploit the two victim children.
4. I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Petition stands dismissed.
5. Additionally it was also informed that the first petitioner had filed Crl.O.P.No. 5475 of 2024 and when that is pending, has filed the present application. That fact is noted.
