O R D E R

The applicant seeks leave to place additional documents on record in support of his case and to meet the defence raised in the written statements. The application has been filed under Order XIV Rule 8 of the Original Side Rules read with Order VII Rule 14(3) CPC, seeking permission to file the additional documents set out in the schedule to the Judge's Summons.

2. Heard the learned counsel appearing for the applicant and the learned counsel for the respondent has no objection to allow the application and also perused the materials available on record.

3. As far as the admissibility, relevancy and proof, it cannot be tested through this application. This application is filed only to grant leave for production of documents belatedly. Therefore, this petition is allowed and the documents can be received subject to proof, relevancy and admissibility.

4. In the facts and circumstances of the case, and in the light of the judgment of the Supreme Court in Bipin Shantilal Panchal v. State of Gujarat, reported in 2001 (3) SCC 1, the petitioner is permitted to mark the photocopy of the document, leaving open the questions of its validity, Page No.2 of 4
