ORDER

This application has been filed seeking for payment out of a sum of Rs.2,50,000/- lying to the credit of O.P.No.284 of 2021.

2. Learned counsel for the respondent has stated no objection for allowing this application.

3. The respondents had earlier filed an application in O.P.No.284 of 2021 seeking to set aside the Arbitral Award passed in favour of the applicant and as against the respondents. By order dated 23.08.2021, this Court had dismissed O.P.No.284 of 2021. Since the Arbitral Award passed in favour of the applicant had obtained finality, the applicant has filed this Application seeking payment out of a sum of Rs.2,50,000/- which is lying to the credit of O.P.No.284 of 2021. The said amount was deposited by the respondents, pending disposal of O.P.No.284 of 2021.

Since the learned counsel for the respondents has stated no objection and since the Arbitral Award which was challenged by the respondents in O.P.No.284 of 2021 has attained finality, this court will have to necessarily allow the application as prayed for. Accordingly, this application is allowed as prayed for, by ordering payment out of a sum of Rs.2,50,000/- lying to the credit of O.P.No.284 of 2021 in favour of the applicant.

5. The Registry shall comply with this order within a period of four weeks from the date of receipt of a copy of this order.
