ORDER

The petitioner apprehends arrest for the alleged offence under Sections 8(c) r/w 20(b)(ii)(B), 22(b), 25 and 29(1) of NDPS Act, 1985 in Crime No.3 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 10 kgs of ganja. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution. Based on the confession statement of the coaccused, the petitioner has been falsely implicated in this case. However, on instructions, the learned counsel further submits that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner along with other accused were found in illegal possession of 10 kilograms of ganja. He further submitted that three previous cases are pending against the petitioner, out of which one case is of similar in nature. Therefore, he strongly opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission of the learned counsel on either side, it is seen that three previous cases are pending against the petitioner and one among them is of similar nature. This clearly shows that the petitioner is repeatedly involving in similar offences and misusing the liberty granted to him. Considering the

gravity of the offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail.
