Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondents to transfer the petitioner as Junior Assistant with all monetary benefits as per the petitioner's representations dated 23.09.2016, 13.10.2016 within time limit fixed by this Court. ORDER
By consent, the writ petition is taken up for final disposal. M..L.P.Shanmugasundaram, learned Special Government Pleader [Coop.] accepts notice on behalf of the respondents. The petitioner would aver that he was appointed as a Driver in the services of the 1st respondent on 12.03.2001 and his services were regularised with effect from 01.09.2007 and subsequently, time scale was also fixed with effect from 01.09.2007 as Rs.5600-20011100-300-12000. The petitioner was also accorded with the benefit of selection grade on 12.03.
2011 and the petitioner also obtained permission from the Tamil Nadu Cooperative Union to undergo Diploma in Cooperative Management Course from Anna Institute of Cooperative Management, Kancheepuram and he has successfully completed the course and also got Diploma and as such, he is eligible to be appointed as Junior Assistant in the Institute of Cooperative Management. The petitioner, in this regard, has also submitted representations through proper channel and the 1st respondent has also made a positive recommendation to the 2nd respondent vide Letter in Na.Ka.No.9193/10/A1 dated 06.02.2016 and since no orders have been passed, the petitioner came forward to file the present writ petition.
Heard the learned counsel for the petitioner and Mr.L.P.Shanmugasundaram, learned Special Government Pleader appearing for the respondents.
Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the 2nd respondent to act on the communication of the 1st respondent dated 06.02.2016 in Na.Ka.No.9193/10/A1 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
The writ petition stands disposed of with the above direction. No costs.
