ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition has been filed under Article 226 of the Constitution of India seeking direction to the Debts Recovery Tribunal, Coimbatore to take up and dispose of I.A.No.2580 of 2023 in S.A.(SR) 1170 of 2023, which is an application for condonation of delay, within a time frame.

2. Learned counsel for petitioner submits that petitioner had approached Debts Recovery Tribunal, Coimbatore in the year 2023 by filing Securitisation Application, challenging the forfeiture letter dated 10.10.2022 issued by respondent bank, along with I.A.No.2580 of 2023 for condonation of delay of 220 days. Though the matter was posted initially on 21.07.2023, it was adjourned from time to time due to non-availability of the Presiding Officer. Since more than three years have elapsed and the condonation of delay application is yet to be

decided, learned counsel seeks a direction for expeditious disposal of the application for condonation of delay.

3. Taking into consideration the fact that the Securitisation Application and condone delay application are pending since 2023, we direct the Debts Recovery Tribunal, Coimbatore to expedite the proceedings and decide I.A.No.2850 of 2023 in S.A.(SR) 1170 of 2023 within a period of two months from the date of receipt of certified copy of this order.
