ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(3) 118(1), 351(3) BNS Act r/w 4 of TNPWH Act in Crime No.24 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The allegations against the petitioner is that the petitioner has given some amount as loan to the defacto complainant's son, subsequently, he has not repaid the same. Hence, on the date of an occurrence, the petitioner herein went to the house of the defacto complainant and attacked her and her husband with knife and caused severe injuries, which led to the registration of the case. Hence, the present petition for anticipatory bail.

The learned counsel appearing for the petitioner submitted that this is the second anticipatory bail petition and the earlier petition was dismissed by this Court in Crl.O.P.No.2923 of 2026 dated 09.02.2026; the injured in this case had sustained only simple injures. He further submitted that it is a false accusation and he is ready to cooperate with the investigation and hence, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) would submit that, in pursuant to the money transactions between the defacto complainant and the petitioner, the petitioner went to the residence of the defacto complainant and assaulted her. The injuries sustained by the defacto complainant were only abrasions on the right hand. Apart from that, the petitioner has one previous case. He further submitted that according to the Accident Register report, the assault was made with a knife. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made on either side.

6. In view of the past antecedents and the nature of the offence, it is not desirable to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
