The relief sought for in the present writ petition is to direct the second respondent to dispose of the petitioner's representation dated 07.12.2018.
2. Even to issue a direction to consider the representation, this Court has to consider the issues involved in the writ petition. Routine issuances of such a direction is certainly undesirable and the learned counsel for the writ petitioner states that a portion of the terminal benefits has been withhold https://hcservices.ecourts.gov.in/hcservices/
by the respondents. The reasons are also stated for a withholding of such terminal benefits which is to be paid to the writ petitioner. However, the order withholding the portion of the terminal benefits was issued by the administrative department of the second respondent/Sugar Mills and against that order, a revision would lie under Section 153 of the Tamil Nadu Co-operative Societies Act. The first respondent has been notified as a Functional Registrar under the Act and therefore, the petitioner has to exhaust, the appellate remedy provided under the Act and in this regard, the writ petitioner is at liberty to approach the competent authority by filing a revision in a prescribed form by paying necessary fee and adjudicate the same before the authority for redressing his grievances.
3. Accordingly, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. -s/d- Assistant Registrar True Copy Sub-Assistant Registrar ssb/kmm To
