Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the petitioner for selection and appointment to the post of Village Assistant based on the interview conducted on 26.2.2021 in pursuant to the call Letter issued by the 2nd respondent in Na.Ka.No.779/2018 / A7 dated 23.02.2021 based on merit in selection without reference to crossing of age limit prescribed for ST category after the initiation of process of selection based on the representation submitted by the petitioner.

O R D E R

The Petitioner has applied for the post of Village Assistant. He belongs to Schedule Caste category and the upper age limit for applying to the post is 35 years. On the date of application he was within 35 years and he was called for interview on 26.02.2021, which he attended and produced all the original certificates. But the appointment order is yet to be issued. In the meanwhile, the petitioner has an apprehension that whether his candidature will be considered or not for the reason that he is crossing the upper age limit by May 2021. https://hcservices.ecourts.gov.in/hcservices/

Therefore, he seeks a direction to consider the case of the petitioner.

2. Mr.P.V.Selvakumar, Additional Government Pleader enters appearance on behalf of the respondents.

3. It is a normal procedure that the applicant should be within the age limit and fully qualified on the date of application. Once he is possessing the necessary qualifications his candidature will be considered. However, writ petition is based on apprehension. Therefore, the petitioner is directed to make a representation to the 1st respondent setting out all the details within a period of two weeks from the date of receipt of the order copy. On such representation being made, the 1st respondent is directed to consider the same on merits and pass orders in accordance with law before completion of selection. With the above direction, the writ petition is disposed of. No costs.
