The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act in Crime No.932 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused were found in possession of 4 kgs of Ganja and on seeing the respondent police, he ran away and A2 was arrested and remanded to judicial custody. Hence the complaint.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and and he has been falsely implicated in this case based on the confession recorded from the arrested accused. He would submit that the petitioner is ready to abide by any stringent conditions that may imposed by this Court. 4. The learned Government Advocate (criminal side) for the respondent would submit that the petitioner, who is a habitual offender, involved Narcotics cases. He would submit that the petitioner is having four previous cases. Out of which, two previous cases are similar offences. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsel and perused the materials available on record.
6. Taking into consideration the bad antecedence of the petitioner has involved in 4 previous cases, out of which, two cases of similar in nature registered by the respondent police, this Court is not inclined to grant anticipatory bail to the petitioner.
