ORDER

Seeking a direction to the respondent to register an F.I.R. based on the petitioner's complaint dated 20.06.2015, and to take necessary action in accordance with law, the petitioner has come up with this petition.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent and perused the material placed on record.

3.The complaint given by the petitioner in connection with missing of documents for which an FIR cannot be registered, as it is not a cognizable offence. Hence, this petition is closed with liberty to the petitioner to work out his remedies in the manner known to law.

This matter having been listed under the caption for 'Being mentioned' on 28.10.2015 persuant to the order on this court dated 16.07.2015 and made herein in the presence of the aforesaid counsel on either side, the court made the following order:

On 16.07.2015, this Court passed the following order: "3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent and perused the material placed on record.

4. The complaint given by the petitioner in connection with missing of documents for which an FIR cannot be registered, as it is not a cognizable offence. Hence, this petition is closed with liberty to the petitioner to workout his remedies in the manner known to law."

2. It is brought to the notice of this Court, that the petitioner required only a CSR to be issued, for the complaint of missing of documents given by him and therefore, the matter was posted under the caption "for being mentioned."

3. Under such circumstances, paragraph No.3 of the order dated 16.07.2015 is deleted and the following paragraph shall be substituted :

"Complaint given by the petitioner in connection with missing of documents, for which, an FIR cannot be registered as it is not a cognizable offence. However, the petitioner is directed to submit a complaint along with paper publication, to the respondent police and on such complaint being submitted, the respondent police shall issue a CSR receipt to the petitioner."
