ORDER

The petitioner apprehends arrest for the alleged offence under Sections 4(1)(a), 4(1)(i) of Tamil Prohibition Act, and sections 4(1)(c), 4(1)(A) of the Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.58 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 30 nos of Tasmac bottles (each containing 180 ml) with intention to sell the same to the public; hence the case.

3. The learned counsel appearing for the petitioner submitted that this is the third anticipatory bail petition and that the earlier petitions were dismissed by this Court in Crl.O.P.Nos.28178 & 18049 of 2025 dated 15.10.2025 & 30.06.2025 respectively; and that he is an innocent person and has been falsely implicated in this case. He would submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that there is no previous case pending against the petitioner. However, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to the submissions made on either side.

6. This anticipatory bail petition arises out of offences under the Prohibition Act cases. If anticipatory bail is granted in such cases, it may

embolden the petitioner to commit similar offences in future. Considering the nature of the allegations, this Court is of the view that the petitioner does not deserve the grant of anticipatory bail. Accordingly, the Criminal Original Petition is dismissed.
