O R D E R
This Civil Revision Petition is filed to quash the proceedings in D.V.C.No.11 of 2023 on the file of the Court of District Munsif cum Judicial Magistrate, Madhavaram.
2. Pursuant to the order of this Court, both petitioner and the Page No.1 of 5
respondent appeared before the mediator and mediation completed. Both the petitioner and the respondent agreed to resolve the issue and settlement agreement entered in Mediation No.361 of 2024. The mediation report from the mediator is also received, by enclosing the settlement agreement between the parties. The settlement agreement executed between the parties is extracted hereunder:- "A. Exchange of Gold Ornaments between the parties on this day of the settlement agreement. B. The Petitioner agreed to repay Rs.1,50,000/-(Rupees One Lakh and Fifty Thousand) by cash to the Respondent towards lent amounts, on the day of filing withdrawal memo/petition for the case D.V.C. No.11/2023 on the file of the Hon'ble District Munsif Cum Judicial Magistrate Court, Madhavaram under the Protection of Women from Domestic Violence Act 2005, the Respondent also accepted the same.
C. Both the Petitioner and Respondent herewith confirm and agree to file an Indian Divorce Original Petition (IDOP) under mutual consent at a competitive court on or before 31st July 2024, without any demand or conditions. Further states that neither party will seek an Page No.2 of 5
extension of time in respect of the IDOP (Mutual Consent) for any cause.
D. Both the parties herewith confirm and undertake to declare that apart from for the above settlement, nothing will lead to further demands, disputes between us.
7. By signing this Agreement, the Parties hereto state that they have no further claims or demands against each other with respect to C.R.P. No.1319 of 2024 against DVC No.11 of 2023 and all disputes and differences in this regard have been amicably settled by the Parties hereto through the process of Mediation."
3. Today, the learned counsel for the petitioner submitted that the D.V.C.No.11 of 2023 withdrawn on 31.07.2024 and hence no Domestic Violence Complaint is pending. As regards filing of divorce petition, it is filed in IDOP SR No.1839 of 2024 before the Family Court, Tiruvallur for divorce by mutual consent.
4. In view of the above settlement agreement dated 19.07.2024, this Civil Revision Petition stands disposed of. No costs. Consequently, the Page No.3 of 5
