JUDGMENT

The accused in S.C.No.59 of 2005 on the file of the learned Sessions Judge, Mahila Court, Salem, is the appellant herein. By the judgment dated 31.7.2009, the appellant was convicted for the offence under Section 394 read with 397 I.P.C. and sentenced to undergo seven years rigorous imprisonment and imposed a fine of Rs.1,000/-, in default, to undergo three months rigorous imprisonment and was convicted for the offence under Section 354 I.P.C. and sentenced to undergo one year rigorous imprisonment. Aggrieved over the said conviction and sentence, the appellant has come up with the present appeal.

2. Today, when the matter was taken up for consideration, learned counsel appearing for the appellant and the learned Additional Public Prosecutor, appearing for the respondent submitted that the appellant had already undergone the entire period of sentence imposed on him and he was released

from prison. Learned Additional Public Prosecutor has also produced a letter dated 18.7.2016 sent by the Superintendent of Prison, Central Prison, Kovai, to that effect.

3. In view of the same, I am of the opinion, nothing survives in this appeal for adjudication and the appeal has become infructuous. Hence, the criminal appeal is dismissed as infructuous.
