Pichandi ... Respondent This case came up for settlement before the Lok Adalat. Both the parties are present. Tmt. Saranya, represented for Mr.G. Thangavel, Counsel for appellant and Mr.T.S. Baskaran, Counsel for the Respondent are present.

O R D E R

The respondents filed the suit for recovery of money in the District Munsif Court Court, Cuddalore and the same was decreed as prayed for. The appellant went on appeal, but the suit appeal dismissed and the decree of the lower court was confirmed. Hence this second appeal has been preferred by the appellant.

2. Pending appeal, the parties entered into a compromise, thereby the respondent agreed to receive a sum of Rs. 80,000/- (Rupees Eighty Thousand Only) and settle the matter.

3. On the said agreement, a sum of Rs. 60,000/- has already been received by the respondent from the appellant. The respondent also undertook to receive the balance amount of

Rs.20,000/- (Rupees Twenty Thousand Only) today to finalise the settlement. Today the respondent received the balance amount of Rs.20,000/- (Rupees Twenty Thousand Only) also.

4. In view of the above compromise between the parties, the appeal stands disposed of as settled.

5. It is represented that Execution Petition in E.P. 125 of 2009 is pending before the learned Principal District Munsif Court, Cuddalore. In view of the above compromise and settlement between the parties, the learned Principal District Munsif, Cuddalore is directed to close the E.P as settled. sd/- Arockiasamy sd/- Counsel for Appellant sd/- sd/- Pichandi Counsel for Respondent This Lok Adalat award is passed in terms of the above settlement.

The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
