O R D E R

The petitioner herein, while working as a 'Village Administrative Officer', was involved in an anti-corruption case and he was arrested on 25.09.2009. Consequently, the petitioner was placed under suspension and in the meanwhile, he attained the age of superannuation on 30.12.2010 and he was not allowed to

retire from service. However, he was paid only the General Provident Fund amount, while the other terminal benefits were not paid. The criminal case that was registered against the petitioner is stated to be still pending and there is a likelihood of further delay in disposing of the said criminal case. In the circumstances, the petitioner claims to have submitted a representation dated 28.11.2015, requesting to disburse the terminal benefits of the petitioner in the light of various orders passed by the Hon'ble Apex Court. However, the said representation was not been considered by the respondents and hence, the petitioner approached this court by filing the present writ petition.

2. Though, this writ petition is of the year 2015, the respondents have not filed any counter-affidavit.

3. The said representation dated 28.11.2015, submitted by the petitioner, appears to be still pending for consideration before the respondents. In the light of the above, this court is of the considered view that it would be appropriate to dispose of this writ petition, directing consideration of the said representation dated 28.11.2015 submitted by the petitioner.

4. Under the circumstances, this writ petition is disposed of directing the respondents to consider the representation dated 28.11.2015 submitted by the petitioner and pass appropriate orders thereon in accordance with law within a period of eight weeks from the date of receipt of a copy of this order for disbursal of terminal benefits of the petitioner. Further, the petitioner is granted liberty to submit an additional representation before the respondents within a period of two weeks from the date of receipt of a copy of this order.

5. Accordingly, the writ petition is disposed of. Consequently, connected miscellaneous petitions, if any, shall stand closed. No costs. 25.10.2024 skr Index : Yes / No Speaking order / Non-speaking order To The Revenue Divisional Officer, Kallakuricihi, Villupuram District.
