JUDGMENT

This appeal has been filed by the complainant against the Judgment of acquittal passed by the Judicial Magistrate No.II, Namakkal in STC.No.708 of 2007 dated 27.07.2009.

2. The appellant herein has filed a private complaint against the respondent herein stating that the respondent herein has committed an offence u/s.138 of the Negotiable Instruments Act. Based on the said complaint, the learned Judicial Magistrate No.II, Namakkal, has taken the case on file in STC.No.708 of 2007. After conducting trial, he acquitted the respondent herein by the Judgment dated 27.07.2009. Aggrieved by the same, the complainant has filed this appeal.

3. Today when the matter is taken up for hearing, both side learned counsel are present. The learned counsel for the appellant represented that the matter has been settled and hence, he is seeking permission to withdraw the appeal. Permission is granted. He has made an endorsement that he is withdrawing the appeal.
