Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 3rd respondent to consider the petitioner's representation dated 09.11.2022, to pass order for cancelling the forged documents in Doc.No.634/2006, 1568/2006, 1568/2007 and 286/2008 within the time frame fixed by this Court. ORDER
This Writ Petition is filed seeking to issue a Writ of Mandamus directing the 3rd respondent to consider the petitioner's representation dated 09.11.2022 and to pass orders for cancelling the forged documents in Doc.No.634/2006, 1568/2006, 1568/2007 and 286/2008, within the time frame as may be fixed by this Court.
2. The learned counsel for the petitioner submitted that the petitioner made a representation dated 09.11.2022 to the 3rd respondent to enquire and cancel the forged sale cancellation deed in Doc. No.634/2006 and other documents in Doc. No.1568/2006, 1568/2007 and 286/2008. Thereafter, the 3 rd respondent issued summons dated 02.01.2023, calling 2/6
the petitioner to appear before him for enquiry on 30.01.2023. Accordingly, the petitioner also appeared before the 3 rd respondent and gave his statement. However, so far, the 3 rd respondent has not passed orders. Hence, the present Writ Petition is filed.
3. Mr.R.Neethi Perumal, learned Government Advocate takes notice for the respondents 1 to 3. Since, no adverse order is being passed against the respondents 4 to 6, notice to the respondents 4 to 6 is dispensed with.
4. Heard and perused the materials available on record.
5. Having regard to the submissions made by the learned counsel on either side and since the Writ Petition is filed seeking a simple Writ of Mandamus, this Court without expressing any opinion with regard to the merits of the case, directs the 3rd respondent to consider the petitioner's representation dated 09.11.2022 and issue notice to the petitioner, the respondents 4 to 6 herein, interested parties/rival claimants/aggrieved parties/objectors if any, as the case may be and conduct enquiry in the manner known to law and pass orders on merits and in accordance with 3/6
law, within a period of six weeks from the date of receipt of a copy of this order.
6. With the above directions, this Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 27.03.2024 ksa-2 Index : Yes / No Speaking Order : Yes / No 4/6
