2/6 PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, direct the 3rd respondent to call for the entire record relating the impugned patta No.1939 endorsement 2025/ 0103/ 35/ 411447 dated 21.01.2025 passed by the 3rd respondent to quash the same and consequently direct the 3rd respondent herein to reissue patta in name of the petitioner late father name to the and comprised in Punjai Survey No.86, admeasuring to the extent of 0.55.50 ares situated in Kadalur village, Cheyyur Taluk, Chengalpattu District.

ORDER

This writ petition has been filed challenging the patta issued in favour of the 5 th respondent by the 3 rd respondent in Patta No.1939, pertaining to the subject property.

2.Heard Mr.A.Venkatesan, learned counsel appearing on behalf of the petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing on behalf of respondents 1 to 4.

3/6 3.In the considered view of this Court, if the petitioner is aggrieved by the patta issued in the name of the 5 th respondent, the petitioner has an efficacious alternative remedy by way of an appeal under Section 12 of the Patta Pass Book Act. In fact, the petitioner has made a representation in this regard before the 2 nd respondent on 03.03.2025. Since the same is pending before the 2 nd respondent, it will be more appropriate to issue direction to the 2 nd respondent to deal with the representation/appeal filed by the petitioner and pass orders. 4.In the light of the above discussion, this writ petition is disposed of with a direction to the 2 nd respondent to deal with the representation/appeal given by the petitioner on 03.03.

2025, on its own merits and in accordance with law after affording opportunity to the 5 th respondent and final orders shall be passed, within a period of eight weeks from the date of receipt of copy of this order. 5.The petitioner is directed to make a fresh representation before the 2 nd respondent along with a copy of the representation dated 03.03.
