Heard Mr.K.Govi Ganesan, learned counsel for the appellant and Mr.M.V.Vijaya Baskar, learned counsel for the respondent.

2.The decree under challenge is one for specific performance. It is stated that the execution petition has been filed seeking execution of sale deed. If the sale deed is executed pending appeal and the appeal is eventually allowed, it will only result in waste of money as well as time of the Court. Hence, the interim order already granted is made absolute.

This Civil Miscellaneous Petition will stand allowed.
