Order This writ petition has been filed to forbear respondents 1 to 4 from transferring Patta or mutating the revenue records with regard to the property, morefully disclosed in the prayer to this writ petition till the disposal of the civil suit in O.S. No.254 of 2021 pending on the file of the Sub Court, Tiruchengode. 2.The petitioner claims that he is the owner of the property, morefully disclosed in the prayer to this petition. The petitioner claims that since disputes were raised by the parties with regard to the petitioner's ownership, the petitioner had filed a civil suit in O.S. No.254 of 2021 on the file of the Sub Court Tiruchengode seeking for declaration that the petitioner is the absolute owner.
According to the petitioner, despite pendency of the civil suit, respondents 1 to 4, based on an application submitted by the fifth respondent, may mutate the revenue records for the very same property in favour of the fifth respondent. Only under those circumstances, this writ petition has been filed to forbear respondents 1 to 4 from transferring patta or mutating the revenue records.
3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 4. He would submit that the fifth respondent is not a party to the civil suit in O.S. No.254 of 2021.
4.Learned counsel for the petitioner would submit that the fifth respondent is staking a claim over the very same property, which is the subject matter of the suit filed by the petitioner in O.S. No.254 of 2021 and hence, the petitioner must be heard before mutating the revenue records at the behest of the fifth respondent.
5.No prejudice would be caused to the respondents if the petitioner is heard as and when any application is submitted by the fifth respondent seeking for mutation of the revenue records pertaining to the very same property, which is morefully disclosed in the prayer to this writ petition. 6.Since no adverse orders are being passed against the fifth respondent in this writ petition, notice to the fifth respondent is dispensed with. 7.For the foregoing reasons, this writ petition is disposed of by directing respondents 1 to 4 to issue notice to the petitioner and hear his objections whenever any application is submitted by the fifth respondent seeking for mutation of the revenue records for the very same property, which is the subject matter of this writ petition and only after hearing the objections of the petitioner, the official respondents shall pass final orders, on merits and in accordance with law on the fifth respondent's application seeking for mutation of the revenue records in his name.
