Respondent PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondent herein to conduct proper enquiry regarding reissue of passport vide No.M1067687570714 dated 16.12.2016 pending from 16.12.2016 onwards and consider the same within a stipulated period.

Mr.T.V.Krishnamachari, learned senior panel counsel takes notice for the respondent. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a Mandamus directing the respondent to conduct enquiry and reissue the seized passport to the petitioner based on his application dated 16.12.2016.

3. It is stated that the petitioner's passport was seized, based on an allegation that a fake Italian Visa was stamped in the petitioner's passport.

4. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the respondent to consider and decide. Therefore, without expressing https://hcservices.ecourts.gov.in/hcservices/

any view on the merits of the claim made by the petitioner, this Court directs the respondent to consider the application of the petitioner dated 16.12.2016 on merits and in accordance with law and pass orders on the same within a period of six weeks from the date of receipt of a copy of this order. The Writ Petition is disposed of accordingly. No costs.
