Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner herein, who apprehends arrest by the 3rd respondent police on the complaint given by one Ruchika Sancheti alleging dowry harassment and other related offences.

2. The petitioner herein seeks interstate anticipatory bail to visit Jaipur as the health condition of his mother is deteriorated and he has quoted this as one of the reasons for seeking interstate anticipatory bail.

3. On reading the First Information Report, the marriage was took place on 18.06.2017. Due to discord, the de facto complainant has left the matrimonial home and had gone to her parents' house at Jaipur. She has also lodged a complaint for dowry harassment. On the part of the petitioner herein, he has initiated a petition for https://hcservices.ecourts.gov.in/hcservices/

dissolution of marriage in O.P.No.1602 of 2021. It is a case of the petitioner that the de facto complainant had gone to her parents' house on her own volition taking all her jewels and other articles.

4. The learned counsel for the petitioner relied upon the judgment of this Court regarding grant of Interstate anticipatory bail, submitted that this Court may grant Interstate anticipatory bail to the petitioner to work out his remedy before the competent jurisdictional Court.

5. However, considering the nature of the complaint and the reason stated in the petition seeking interstate anticipatory bail, this Court is of the view that it is for the petitioner herein to work out his remedy before the appropriate jurisdictional Court for the allegations made against him. Without any material to assess the gravity of the crime, this Court cannot give any protection to the petitioner in an offence of this nature. Hence, this Criminal Original Petition is dismissed accordingly.
