[Order of the Court was made by M.SUNDAR, J.,] After some arguments, learned counsel Mr.J.Jayan (Enrollment No.2388/16) with address for service at No.155, Thambu Street, Third Floor, Chennai, representing the counsel on record for writ petitioner sought leave of this Court to withdraw the captioned writ petition but made a plea to preserve the rights and contentions of the petitioner to avail statutory remedies, if available, more particularly statutory remedy of an appeal under Section 10 of 'The Tamil Nadu Land Encroachment Act, 1905' [hereinafter 'said Act' for the sake of brevity] and a scanned reproduction of the endorsement made by learned counsel in the case file is as follows: Page Nos.2/5
2. In the light of the narrative thus far, captioned writ petition is disposed of as closed/withdrawn albeit preserving all the rights and contentions of the writ petitioner to avail statutory remedies or any other remedy qua 28.11.2023 proceedings under Section 6 of said Act. To be noted, aforementioned course is adopted as the representation dated 18.12.2023 qua which a mandamus has been sought in the captioned WP has been sent after receipt of the aforementioned notice dated 28.11.2023. Captioned writ petition disposed of in the aforesaid manner albeit preserving all the rights of the writ petitioner in the aforesaid manner. There shall be no order as to costs.
