This petition has been filed to condone the delay of 253 days in filing the above appeal.

Though notice was served on the first respondent, he has not appeared before this Court either in person or through Advocate. 3.

Ms.I.Malar, learned counsel, who takes notice for the second respondent, fairly submits that she has no serious objection to the delay of 253 days being condoned subject to the condition that the petitioner forfeits interest for the delay period of 253 days.

In view of the above submission made by the learned counsel for the second respondent, the delay of 253 days is condoned on condition that the petitioner forfeits interest for the delay period. 5.

The Registry is directed to number the appeal, if it is otherwise in order and post the same for admission. The Registry is further directed to print the name of the learned counsel for the second respondent in the cause list at the time of admission.
